1. Scope of these Terms

These Terms & Conditions apply to reservations made directly through the VillaSpace website or otherwise confirmed directly by VillaSpace. By completing a reservation, the lead guest confirms that they have read and accepted:

  1. these general Terms & Conditions;
  2. the description, facilities, occupancy limits and house rules of the selected property; and
  3. the specific price, rate option, cancellation policy, payment schedule, security deposit and any other conditions displayed during the online booking process and included in the booking confirmation (the “Specific Booking Conditions”).

Each property, travel period and rate option may have different Specific Booking Conditions. Not every property offers the same payment, cancellation or security-deposit arrangements.

If there is any conflict, the Specific Booking Conditions accepted during the booking process and recorded in the booking confirmation shall prevail over the property description and house rules, and these shall prevail over these general Terms & Conditions. Mandatory provisions of applicable law shall always prevail.

For reservations made through a third-party booking website, the terms and conditions displayed and accepted on that website, together with the corresponding booking confirmation, shall govern payment and cancellation matters. These Terms & Conditions shall apply only on a supplementary basis where appropriate.

2. VillaSpace’s Role and the Accommodation Contract

VillaSpace is operated by Hellen Suyen Mena Fuentes, tax identification number ES30853609Y.

Unless the booking confirmation expressly states otherwise, VillaSpace acts as booking and property-management intermediary on behalf of the owner of the holiday accommodation. The accommodation contract is entered into between the guest and the homeowner, with VillaSpace acting on the homeowner’s behalf in managing the reservation and stay.

VillaSpace remains responsible for its own acts and obligations to the extent required by applicable law.

The accommodation is provided exclusively for temporary holiday use for the dates stated in the booking confirmation. The reservation does not create a residential tenancy or confer any right to use the property beyond the confirmed stay.

3. Booking and Confirmation

The person making the reservation (the “lead guest”) must be at least 18 years old, have the legal capacity to enter into the agreement and be authorised to accept these Terms & Conditions on behalf of every member of the group.

A property may establish a higher minimum age, require prior approval for certain groups or apply an additional security deposit. Any such requirement will be stated in the property information, house rules, Specific Booking Conditions or booking confirmation.

All information supplied during booking must be complete and accurate. The lead guest is responsible for checking the property, dates, number and ages of guests, selected rate, total price and all Specific Booking Conditions before completing the reservation.

A reservation is confirmed only when VillaSpace issues a booking confirmation and any payment or payment authorisation due at that stage has been successfully completed. A booking request, quotation or temporary availability hold does not constitute a confirmed reservation unless VillaSpace expressly confirms otherwise in writing.

4. Prices, Inclusions and Additional Charges

The total price and its breakdown will be shown during the booking process and recorded in the booking confirmation. The price may include the accommodation charge, cleaning fees, taxes and other applicable charges. Items payable separately will be identified wherever applicable.

Facilities and services vary by property. Wi-Fi, air conditioning, heating, electricity, water, bed linen, towels, pool towels, cots, high chairs, cleaning services, parking and other facilities are included only where stated in the property description or Specific Booking Conditions.

Some properties may charge separately for utilities, optional services, additional guests, pets, late arrival, early check-in, late check-out or exceptional consumption. The applicable basis and amount will be stated before booking, in the property information or in a separate written agreement made before the service is provided.

5. Payment Conditions

The amount payable, payment method and due date are specific to each reservation and are those displayed during the booking process and confirmed in writing.

Depending on the property, dates, length of stay and selected rate, the payment schedule may require:

  • payment of the full reservation amount when the booking is confirmed;
  • an initial payment calculated as a percentage or fixed amount, followed by payment of the remaining balance on the date stated in the booking confirmation;
  • two or more scheduled instalments;
  • payment of the remaining balance before check-in, at check-in or at another specified stage; or
  • a separately scheduled security deposit or card authorisation hold.

Payment will normally be collected from the card supplied during booking. Bank transfer, cash or another method is available only where expressly offered or agreed in writing. By providing a payment card, the lead guest authorises the collection of the confirmed payments on their respective due dates.

If a scheduled payment fails or is not received by its due date, VillaSpace may ask the lead guest to provide a valid payment method or complete the payment within a reasonable period. If payment remains outstanding, the reservation may be cancelled and the cancellation policy applicable to that reservation will apply.

Any approved change to the total reservation price may result in a corresponding adjustment to pending payments. The updated amount and payment schedule will be confirmed in writing.

6. Cancellation Policies

The cancellation policy is specific to the property, dates and rate option selected by the guest. Some stays may offer more than one rate for the same property and dates—for example, a higher-priced flexible rate and a lower-priced non-refundable rate. The policy attached to the rate selected and accepted by the guest is the only policy applicable to that reservation.

Depending on the option shown during booking, the free-cancellation deadline may be:

The exact cancellation deadline, including its date and time, will be displayed during the booking process or in the booking confirmation and shall prevail over the general descriptions above.

Where free cancellation applies, cancellation received before the stated deadline will be refunded in accordance with the Specific Booking Conditions. If the guest cancels after that deadline, the applicable cancellation charge may be:

  • the price of the first night;
  • 50% of the total reservation price;
  • 100% of the total reservation price; or
  • another amount expressly stated in the Specific Booking Conditions.

A reservation made after the free-cancellation deadline has already passed may be shown and confirmed as non-refundable from the time of booking.

To cancel, the lead guest must use any cancellation function provided with the reservation or notify VillaSpace in writing. The cancellation becomes effective when it is received. Any refund due will be returned to the original payment method unless another method is agreed or legally required.

Failure to arrive, arrival after the reserved date, early departure or failure to use any part of the stay does not entitle the guest to a refund except where the applicable cancellation policy or mandatory law provides otherwise.

Accommodation booked for specified dates is not subject to the general 14-day statutory right of withdrawal applicable to certain distance contracts. The cancellation rights available to the guest are therefore those stated in the Specific Booking Conditions, without prejudice to any mandatory rights that may apply.

7. Changes to a Reservation

Requests to change dates, property, guest numbers or other booking details are subject to availability, the property’s occupancy rules and written approval. A change may result in a different price, rate option, payment schedule, security deposit or cancellation policy.

No requested change is valid until it has been confirmed in writing. If a change cannot be approved, the original reservation remains in force. If the guest chooses not to keep it, the cancellation policy attached to the original reservation will apply.

8. Cancellation or Material Change by the Homeowner or VillaSpace

If the booked property becomes unavailable for reasons for which the homeowner or VillaSpace is responsible, VillaSpace will inform the guest as soon as reasonably possible and will offer, where available, suitable alternative accommodation or a refund of the amounts paid for the unavailable accommodation.

If a material change or cancellation results from circumstances beyond reasonable control, VillaSpace will explain the available options and apply the Specific Booking Conditions and applicable law. Nothing in this section limits any mandatory consumer right or remedy.

9. Security Deposit and Card Authorisation

Some properties require a security deposit. Its amount, payment or authorisation method, timing and release conditions are property-specific and will be stated during booking, in the property information or in the booking confirmation.

Depending on the reservation, the security deposit may be:

  • charged to a payment card and refunded after departure;
  • secured through a temporary card authorisation hold;
  • paid in cash on arrival; or
  • paid by bank transfer or another expressly agreed method.

After check-out, the property will be inspected. Reasonable and documented amounts may be retained or charged for damage, missing items, lost keys, exceptional cleaning, unpaid property-specific charges or other losses caused by the guest or members of the group. The guest will be informed of any deduction and supporting details will be provided where appropriate.

The remaining deposit will be refunded or the authorisation hold released within the period stated in the Specific Booking Conditions or, if no period is stated, without undue delay after the inspection has been completed. The time taken for a released card authorisation or refund to appear may also depend on the guest’s bank or card issuer.

The security deposit does not limit the guest’s liability where the documented loss exceeds the amount held.

10. Sustainable Tourism Tax and Other Statutory Charges

The Balearic Islands Sustainable Tourism Tax is payable by all guests who are not legally exempt. Its amount depends on the applicable legislation, the type of accommodation, the season, the length of stay and the guest’s circumstances.

The booking process or confirmation will state whether this tax is included in the total price or must be paid separately, together with the accepted payment method. Guests must provide any information reasonably required to calculate the tax or verify a legal exemption.

11. Guest Numbers, Ages and Group Conditions

The property may be occupied only by the guests included in the reservation, up to the maximum permitted occupancy. All guests, including children and infants, must be declared accurately when booking.

Visitors, events, celebrations and parties are not permitted unless VillaSpace has given prior written approval. Approval may be subject to occupancy limits, an additional charge, an increased security deposit and further conditions.

Some properties do not accept groups composed entirely or predominantly of young guests, while others accept them subject to prior approval or an increased security deposit. The exact minimum-age and group conditions applicable to the selected property will be those shown during booking, in its house rules or in the booking confirmation.

Children and minors must be supervised by a responsible adult at all times, particularly around swimming pools, hot tubs, stairs, sports equipment and other potentially hazardous areas.

12. Check-in, Check-out and Keys

Check-in and check-out times vary by property and will be stated in the property information or booking confirmation. Early check-in and late check-out are subject to availability and may incur an additional charge where stated or agreed in advance.

The lead guest must provide the expected arrival time and promptly notify VillaSpace or the designated property manager of any delay. Failure to provide accurate arrival information may delay access to the property.

Keys may be provided in person or through a key safe or other access system. The applicable instructions will be supplied before arrival once the required payments, guest registration and other pre-arrival requirements have been completed.

13. Guest Registration

The lead guest and every member of the group must provide the identification and traveller information required by applicable Spanish law within the requested timeframe. The required information may be collected before arrival or during check-in and may be communicated to the competent authorities as legally required.

Failure to complete mandatory guest registration may prevent or delay check-in and does not release the guest from the payment or cancellation conditions of the reservation.

14. Use of the Property and House Rules

The guest must use the property responsibly and exclusively for the holiday purpose stated in the reservation. Guests must comply with applicable law, community rules, the property’s house rules and reasonable instructions issued for safety or proper use of the accommodation.

In particular, guests must:

  • respect the stated quiet hours and avoid disturbing neighbours;
  • refrain from dangerous, offensive, illegal or antisocial conduct;
  • avoid parties, events or unauthorised commercial activity;
  • use air conditioning, heating, water and electricity responsibly;
  • keep doors and windows closed when air conditioning or heating is operating where required;
  • report damage, breakdowns, leaks or safety concerns promptly; and
  • leave the property reasonably clean and tidy, dispose of rubbish as instructed and wash or load used dishes before departure.

An additional reasonable cleaning charge may be applied where exceptional cleaning is required beyond normal turnover cleaning.

Smoking is prohibited inside all properties. Any additional smoking restrictions applicable to terraces, gardens or other areas will be stated in the house rules.

15. Pets

Pets are permitted only where the selected property expressly allows them and, where required, VillaSpace has approved them in writing before arrival. Property-specific limits, charges and rules concerning number, size, supervision, furniture, gardens and cleaning must be observed.

Bringing an unauthorised pet may result in an additional cleaning charge, refusal of check-in or termination of the stay where proportionate and legally permitted.

16. Care of the Property, Damage and Access

The guest must keep the property, furniture, equipment and contents in substantially the same condition as at check-in, allowing for reasonable wear and tear. Breakages, damage and missing items must be reported as soon as they are discovered.

The homeowner, VillaSpace, the property manager or authorised contractors may enter the property on reasonable notice where access is required for inspection, maintenance or repair. Immediate access may be required in an emergency or where there is a reasonable concern regarding safety, serious damage or a material breach of the booking conditions.

In the event of a serious or repeated breach, VillaSpace or the homeowner may require the guest and group to leave the property, provided that the action is proportionate and permitted by law. Any refund will be determined under the applicable booking conditions and mandatory law.

17. Maintenance and Service Interruptions

The guest must inform VillaSpace or the designated property manager promptly if an appliance, utility, facility or service is not working correctly. Reasonable efforts will be made to investigate and remedy the issue as soon as practicable.

Occasional breakdowns or interruptions may occur. Any remedy, price reduction or compensation will depend on the nature, duration and impact of the issue, the response provided and the guest’s rights under applicable law. No provision in these Terms excludes a remedy that cannot legally be excluded.

18. Complaints

Any problem or complaint should be reported to VillaSpace or the designated property manager as soon as possible during the stay so that there is a reasonable opportunity to investigate and resolve it.

If the matter remains unresolved, the lead guest should submit the complaint in writing, preferably within seven days after check-out, explaining the issue and including any relevant evidence. This preferred timeframe does not reduce any mandatory statutory right or limitation period.

Official complaint forms are available where required by law.

19. Third-Party Services and Optional Extras

Optional services or products—such as transfers, catering, massage, activities, equipment rental or tickets—may be supplied by the homeowner, VillaSpace or an independent third party. The identity of the supplier, price and applicable conditions should be confirmed before purchase.

Where an independent provider supplies the service, a separate agreement is formed between the guest and that provider. VillaSpace is not responsible for the independent provider’s performance except to the extent that liability arises from VillaSpace’s own acts or cannot legally be excluded.

20. Travel Insurance

Guests are strongly advised to obtain suitable travel insurance covering cancellation, illness, accident, travel disruption, personal belongings and any other risks relevant to their circumstances. Choosing not to obtain insurance does not alter the cancellation or payment conditions of the reservation.

21. Liability

Guests are responsible for their own personal belongings and for taking reasonable precautions during their stay. Neither the homeowner nor VillaSpace is responsible for loss, damage, injury or disruption unless caused by a breach of legal duty, negligence or another basis of liability recognised by applicable law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited.

22. Personal Data and Cookies

The controller responsible for the personal data processed in connection with VillaSpace is Hellen Suyen Mena Fuentes, tax identification number ES30853609Y. Personal data is processed for the management and performance of the reservation, payment administration, guest support, compliance with legal obligations, security and other purposes described in the Privacy Policy published on the VillaSpace website.

Marketing communications will be sent only where there is a valid legal basis. Guests may withdraw consent or unsubscribe at any time without affecting the lawfulness of earlier processing.

The use of cookies and similar technologies is governed by the Cookie Policy and the choices made through the website’s cookie controls.

Requests concerning personal-data rights may be sent to info@villaspace.net, together with the information reasonably necessary to verify the requester’s identity. Guests should not send copies of identity documents unless specifically and lawfully required.

23. Invoices and Receipts

Prices include applicable taxes unless the booking process expressly states otherwise. Any invoice or receipt required by law will be issued in accordance with the applicable tax rules.

Guests requiring an invoice made out to a business or another person should provide the complete invoicing details before payment or as early as possible after booking.

24. Governing Law and Jurisdiction

These Terms and the accommodation agreement are governed by Spanish law.

Any dispute shall be submitted to the courts and authorities determined by applicable procedural and consumer-protection law. Nothing in these Terms deprives a consumer of the mandatory protection or jurisdiction available under the law of their habitual residence where such rules apply.

25. Severability and Changes to these Terms

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

The Terms & Conditions in force when the reservation is confirmed will govern that reservation. Later amendments published on the website will not apply retroactively unless required by law or expressly accepted by the guest.
